The following are terms and conditions for the sale of goods that will govern any contract for sale that we enter into with you.

These terms and conditions tell you the rights and obligations you have. Please read these carefully. You may have other rights granted by law and these Terms and Conditions do not affect these.
This does not affect your statutory rights as a consumer.

If you have any complaints about our service or any goods or services that you purchase from us please contact us at the address above.

Damaged or defective goods
You should inspect the goods when you receive them for defect or damage. If you find any defect or damage you must notify us within 24 hours, so as arrangements for replacements can be made.
If you are a business or if the goods are used wholly or in part for business purposes we shall not be liable to you for any business loss including loss of profits (whether direct or indirect ) business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result or the purchase of goods from us. Any other liability shall be limited to the price paid for the goods.

If you have an account with us payment is due 30 days after the date of our invoice and we may charge interest for late payment calculated daily at 4% above Barclays Bank base rate both before and after judgment.

If you are a consumer you have the right, in addition to your other rights, to cancel the contract and receive a refund, provided that the goods are complete with all relevant packaging in an unused and re-saleable condition. You must inform us in writing of your desire to cancel within seven working days starting on the day after the day the goods are delivered to you. You must return the goods to us at your cost and we advise you to ensure the goods are adequately insured during any return journey. If you have not returned the goods within 14 days of cancellation or if requested we can collect the goods from you at your cost.

Suitability for Use
We take every care to ensure that products supplied are of the highest quality. It is however the user's responsibility to ensure that the goods purchased are suitable for their particular requirements. Many of our products are natural substances that have varying effects in different circumstances. We will not accept claims under any circumstances for work alleged to have been adversely affected by use of a product that proves to be unsatisfactory. Our liability is therefore confined to the value of the goods alone.

Copyright and other intellectual property rights deriving from our work remain with us unless otherwise agreed by us in writing.

Force Majeure
We will be released from any liability to the customer if performance of the contract is delayed or prevented by any cause whatsoever beyond our control.

Disputes
Any dispute arising between the customer and us under these terms and conditions shall be determined by English Law.

Mail Order

Bird & Davis Ltd will not guarantee delivery dates, times or promise that goods will be delivered on such dates. Bird & Davis Ltd deem goods delivered, on collection by courier. Whilst we endeavour to complete orders on schedule, at times this may not possible. Once goods have been collected by  our courier we have no control whatsoever. All mail-orders are despatched on a "Next-Day" non-guaranteed service. This means that delivery of your goods may take UP TO 3 working days to reach you.
 

Surcharges

Various parts of the British Isles have surcharges placed on them by the courier. Therefore we are obliged to pass on any surcharges raised. Please note that these surcharges will be charged at the price ruling at the time of order. Bird & Davis Ltd will inform you of any surcharges when you place your mail-order. You therefore have the option to proceed or cancel your order placed if you so wish.

Product Specifications

Specification and compositions of products mentioned on our website and in our pricelists are accurate at the time of publication. We reserve the right to alter specifications without notice as some products may alter due o policy changes, non-availability of some ingredients o as par of a larger prices of product improvement. Whilst we have made every effort to illustrate various products on our website and pricelist as near to he original product as possible there may be alteration in the way products are packed or labelled after the release of our pricelist and website.
